1. About these terms

These Terms & Conditions (“Terms”) govern your use of the HeyOhm website, applications, and services (the “Service”) to create tips videos, product ads, images, and other AI-assisted content, and to publish it to accounts you connect. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. Questions about these Terms: [email protected].

2. Your account

You must be at least 18 years old (or the age of majority where you live) to use the Service. Keep your account details secure and provide accurate registration information. You are responsible for activity you authorise through your account. If you forget your password, you can reset it from the sign-in page using your account email.

If you invite people to your workspace, they can see and use the workspace’s content and credits according to the role you give them, and you are responsible for their use of the Service. Only the workspace owner manages billing.

3. Your content and permissions

Upload only material you own or have permission to use. Obtain appropriate permission before using another person’s face, voice, likeness, or personal information — including before creating a Creator from a recording of someone other than yourself. You remain responsible for the legality and accuracy of content you submit and publish.

You keep ownership of the content you upload and, subject to these Terms and the licences of the AI models used to make it, of the output you generate, including for commercial use. You give HeyOhm permission to host, process, and display your content to operate the Service. Your content is private to your workspace on every plan, including the Free plan: we do not show it to other HeyOhm users or on our public pages unless you agree.

4. Responsible use

Do not use HeyOhm for unlawful activity, fraud, impersonation, infringement, harassment, or misleading claims. Do not create or share content that is sexually explicit, hateful, or harmful to minors; that breaks the rules of the platforms you publish to (such as TikTok, TikTok Shop, or Instagram); or that attempts to disrupt, reverse-engineer, or gain unauthorised access to the Service. Review generated content before publishing, including product information, advertising claims, and required disclosures.

5. AI-generated results

AI output may contain errors, may resemble other output, and may require editing. Results do not guarantee sales, audience growth, platform approval, or exclusive intellectual-property rights. You are responsible for checking output before you publish or rely on it, and for any disclosure of AI-generated or synthetic media that the law or a platform requires.

6. Plans, credits, and payments

Review the plan details and checkout information before purchasing. Prices are shown in US dollars and payments are processed by Stripe. Subscriptions renew each month until the workspace owner cancels them from the Billing page.

Making content uses credits. A paid plan adds its credits at the start of each billing period, and plan credits left over at the end of a period do not carry over. Credits you buy separately stay in your workspace until you use them. Free-plan credits are given once, at sign-up. If a generation fails, the credits it reserved are returned to your workspace.

Except where required by law, payments and credits that have been used are not refundable.

7. Availability and account closure

We work to keep the Service available, but it may change, be interrupted, or be limited from time to time, and features that rely on connected platforms depend on those platforms. You may stop using the Service at any time, and you can ask us to close your account by writing to [email protected]. We may suspend or close an account that breaks these Terms, or to protect the Service or other users. Provisions that by their nature should survive closure will survive.

8. Liability, disputes, and changes

Nothing in these Terms is intended to remove rights that cannot lawfully be excluded. Apart from those, the Service is provided “as is”, HeyOhm is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid for the Service in the twelve months before the claim. These Terms are governed by the laws of Malaysia.

We may update these Terms. If we make material changes, we will tell you through the Service before they take effect, and your continued use after that means you accept them.
