Welcome to Hey OHM. These Terms & Conditions (“Terms”) govern your access to and use of the Hey OHM website, applications, and services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Hey OHM is an AI-powered platform for creating, transforming, and publishing video content. Features include generating video from text, images, or product information; voiceover, lip-sync, translation, and avatars; and connecting third-party accounts (such as TikTok and TikTok Shop) to publish content and view performance.

2. Eligibility & Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You are responsible for the accuracy of your account information and for safeguarding your credentials. You are responsible for all activity under your account.

3. Credits & Payment

The Service operates on a credit-based model. Generating content consumes credits, which may be granted, included in a subscription, or purchased. Fees, subscription terms, and credit costs are shown in the Service and may change. Except where required by law, payments and consumed credits are non-refundable.

4. Your Content

You retain ownership of the content you upload and, subject to these Terms and applicable third-party model licenses, of the outputs you generate. You grant Hey OHM a license to host, process, and display your content solely to operate and improve the Service. You represent that you have the rights to all content you submit and that it does not infringe any third-party rights.

5. Acceptable Use

You agree not to use the Service to create or distribute content that:

• is unlawful, infringing, defamatory, deceptive, or fraudulent;
• impersonates a person without consent or creates misleading synthetic media;
• is sexually explicit, hateful, harassing, or harmful to minors;
• violates the policies of connected platforms (e.g. TikTok, TikTok Shop); or
• attempts to disrupt, reverse-engineer, or gain unauthorized access to the Service.

6. Third-Party Integrations

When you connect a third-party account (such as TikTok or TikTok Shop), you authorize Hey OHM to access and act on that account as you direct (for example, to publish videos or read performance data). Your use of those platforms is also governed by their own terms and policies. Hey OHM is not responsible for third-party services, and connected platforms may change or revoke access at any time.

7. AI-Generated Content

Outputs are produced by automated models and may be inaccurate, biased, or unexpected. You are responsible for reviewing generated content before publishing or relying on it, and for ensuring it complies with applicable laws and platform policies, including any required disclosure of AI-generated or synthetic media.

8. Intellectual Property

The Service, including its software, design, and trademarks, is owned by Hey OHM and its licensors and is protected by law. These Terms do not grant you any rights in Hey OHM’s intellectual property except the limited right to use the Service as permitted here.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Provisions that by their nature should survive termination will survive.

10. Disclaimers & Limitation of Liability

The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, Hey OHM is not liable for any indirect, incidental, or consequential damages, and our total liability is limited to the amounts you paid for the Service in the twelve months before the claim.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service. Your continued use after changes take effect constitutes acceptance of the updated Terms.
